Mortgage Banking Associate Attorney Position Overview:
We are seeking a motivated Mortgage Banking Associate Attorney to join our team. This role offers an excellent opportunity for an attorney with general litigation experience to develop expertise in mortgage banking litigation under the guidance of seasoned professionals.No previous experience in mortgage banking required, training will be provided.
Key Responsibilities:
- Handle litigation matters involving lien validity and priority disputes, including challenges related to fraud, forgery, and mechanic’s liens.
- Assist with foreclosure actions, including prosecuting judicial foreclosures, acquiring receivership appointments, and addressing title clouds or bankruptcy stays.
- Defend financial institutions against lender liability claims, including allegations related to loan origination (TILA, RESPA), loan servicing (FDCPA, FCRA), and wrongful foreclosure.
- Represent clients in loan repurchase/indemnity disputes and recoupment actions involving loan fraud or professional negligence.
- Draft and review pleadings, motions, and other legal documents.
- Conduct legal research, prepare case strategy, and represent clients in state and federal courts, including Bankruptcy Court.
Qualifications:
- Juris Doctor (JD) degree from an accredited law school.
- Active membership in good standing with the CA Bar.
- Minimum of 3 years of experience in general litigation.
- Willingness to learn the nuances of mortgage banking litigation and related financial services law.
- Strong litigation skills, including deposition, motion practice, and trial preparation experience.
- Exceptional legal research, analytical, writing skills and command of civil procedures
- Ability to manage multiple cases and deadlines effectively.
- Team-oriented with excellent communication and interpersonal skills.
